By submitting a techno babble phrase, Contest Entrant warrants and represents that:
(a) it is his or her original idea or work and that he or she is its rightful owner;
(b) it has not been entered in or won previous contests;
(c) it does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other legal or moral rights of any third person or entity.
In addition, Contest Entrant irrevocably and in perpetuity grants and gives ActiveObjects all worldwide right, title, and interest in and to any techno babble phrase submitted by Contest Entrant and to all intellectual property created by Contest Entrant arising out of participation in the ActiveObjects Techno Babble Contest, and the ownership of same shall be vested totally in ActiveObjects for its own use and disposition. In respect of copyright, this assignment shall be effective for the entire duration of the copyright in all countries throughout the world and shall include, but not be limited to, all rights to derivative works and the right to alter the submitted techno babble phrase at ActiveObjects’s sole discretion.
By entering ActiveObjects’s Techno Babble Contest, Contest Entrant agrees to be bound by the Contest’s rules and conditions and the decisions made by ActiveObjects. Contest Entrant also agrees to release ActiveObjects from any liability whatsoever, and waives any and all causes of action, related to any claims, costs, losses, or damages of any kind arising out of or in connection with the above Contest, whether under a theory of contract, tort (including negligence), warranty or other theory.
